LIMA Work Permits
Certain jobs require a positive LMIA before applying for a Work Permit. In fact, in most cases, a LMIA is required before foreign workers can be hired with certain exceptions under NAFTA and GATS. The criteria to hire a foreign worker is primarily based on the ability of the employer to show that a Canadian worker is not available to perform the job.
In order to prove this, employers need to show that they have made efforts to recruit available Canadain citizens, that wages that are offered for the position are consistent with the prevailing wage rates, that working conditions meet the current provincial labour market standards and that there is a benefit to the Canadian labour market by hiring a foreign worker.
